Annual Snapshot 2021 - Supreme Court 's Important Judgments/Hearings

While COVID has continued to dominate the first half of this year at the Supreme Court, the year did not start with the same worry. Rather, the Court was debating important and politically divisive subjects at the time.

Central Vista Project


The Court reached a decision in the Central Vista case early this year. The Union's plan to reconstruct the heart of the capital was approved by the Court by a 2:1 vote. They didn't become involved in executive policy decisions.

Farm Laws


Nonetheless, the continued farmers' protests against the three 'farm laws' dominated the early months. The Court, in a possibly novel step, put a hold on the legislation' implementation. They formed a committee to listen to the farmers' concerns and arbitrate talks with the administration. Later, during the year end of 2021, the Prime Minister decided to revoke all the 3 Farm Laws.

Gender Equality

Housework is frequently given no economic value because much of it is done by family members with no direct monetary recompense. 

In Kirti v. Oriental Insurance, the Supreme Court acknowledged the gendered aspect of housework and determined that it has economic value.

POCSO Act


The Bombay High Court's Nagpur bench had ruled that if there was no skin-to-skin contact, it would not be considered sexual assault under POCSO (The Protection of Children from Sexual Offences Act, 2012)

The Attorney General pursued the case to the Supreme Court, which overturned the High Court's decision in Attorney General v. Satish.

Privacy and freedom of speech

Munawar Faruqui was detained when the complainants suspected him of cracking a joke. 

The Supreme Court granted him release after a little more than a prison sentence on the grounds that the guideline under Section 41 CrPC (Criminal Procedure Code) had not been followed.

Sedition charges on Vinod Dua 


For criticizing the government's handling of the pandemic, Vinod Dua was charged with sedition. The allegations were dismissed because simple criticism of the administration did not constitute incitement to disorder, according to the court.

Pegasus Spyware



One issue that rocked the country a few months ago was the use of Pegasus spyware on the phones of citizens. The Supreme Court in Manoharlal Sharma v. UoI constituted a committee to enquire into the allegations.

Delhi Riots


A Delhi Assembly committee has summoned Facebook to investigate the riots that erupted in the capital in early 2020. In Ajit Mohan v. Legislative Assembly, National Capital Territory of Delhi, Facebook unsuccessfully disputed the summons. There were also a few remarks regarding long debates.

Reservation for EWS


Reservation for Economically Weaker Sections was one of the most significant breakthroughs in India's affirmative action policy (EWS). The government agreed to revise the criteria for eligibility for reservation under the EWS quota during hearings in the case of Neil Aurelio Nunes v. Union of India.
